Terms of Hire

1. About these terms
These terms apply to all hire bookings with Hire and Style by Design, part of By Design Event Group (ABN 14 006 894 122). By placing an order or accepting a quote, you agree to them.

2. Bookings and payment
A booking is confirmed once paid in full online, or once a written quote is accepted and a 50% deposit is paid. The remaining 50% is payable 7 days before the hire collection date, or before the event date where Hire and Style by Design is providing full service.

3. Hire period
The standard hire period is 48 hours from collection or delivery. Items returned late are charged an additional hire fee of $50 per hour, unless other arrangements have been agreed in writing.

4. Security bond
A $500 bond applies to all hires, plus an additional bond of 10% of the booking value for bookings over $3,000. The bond is paid on collection or before delivery, and is refunded within 5 business days of the items being returned and checked, less any charges under clause 7.

5. Cancellations and changes
Cancellations made 7 or more days before the event date receive a full refund, excluding fresh floral orders. Cancellations made less than 7 days before the event date are not refundable, but you will receive a partial credit towards your next booking. Quantity increases are subject to availability. Reductions made within 7 days of the event are not refunded.

6. Collection, delivery and styling
Items can be collected from our Melbourne (2/159 Heidelberg Road, Northcote VIC 3070) or Sydney (38 Jones Street, Ultimo NSW 2007) locations between 9am and 6pm on weekdays, and 10am and 2pm on weekends. Collections and deliveries outside these hours may be arranged at an agreed time for a fee of $250. Delivery, set-up, styling and pack-down are available at an additional quoted cost. Hire and Style by Design will coordinate access and times with the venue.

7. Care, damage and loss
You are responsible for all hired items from collection or delivery until they are returned or collected by us. Items must be returned in the condition supplied, packed in the original boxes and free of food, wax and debris.

  • Cleaning required beyond normal wear: $50 per hour
  • Damaged items: charged at repair cost
  • Lost, stolen or unrepairable items: charged at full replacement cost

Charges are deducted from the bond. Any amount above the bond will be invoiced and is payable within 7 days.

8. Candles and florals
Only candles supplied or approved by us may be used with our items. LED candles are standard. Real flames are allowed only when approved in writing, and additional cleaning charges will apply. Where ordered, faux florals are part of the hire and must be returned. Fresh florals, where supplied, are yours to keep.

9. Intellectual property and use of hired items
All products, centrepiece designs, styling concepts, images and content supplied by Hire and Style by Design are the intellectual property of Hire and Style by Design and By Design Event Group, and are protected by Australian copyright and intellectual property laws. Hiring an item gives you the right to use it at your event during the hire period only. No ownership or other rights pass to you.

You must not, and must not allow or engage anyone else to:

  • copy, re-create, reproduce, replicate or reverse-engineer any hired item or design, in whole or in part
  • measure, photograph or document items for the purpose of reproducing them
  • sell, sub-hire, lend or offer any item for sale or hire to anyone else, or advertise it as available from anyone other than us
  • use images of our items for commercial purposes without our written permission

You are welcome to share photos of your event on social media for personal use, and we would love you to tag us.

Breach of this clause is taken seriously. If it is breached, the full bond is forfeited, and any current or future bookings may be cancelled without refund. We will also seek to recover all loss and damage, including lost revenue and our legal and recovery costs, and may seek court orders to stop the infringing activity.

10. Your rights
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.
